Confirmation and Acceptance of Terms and Conditions

PKFARE reserves the ownership and the operation right of network membership services provided by PKFARE.com. Specific products and services will be provided by qualified service providers. When the user ( “the user” or “you” ) visit, book or use our product or service(collectively referred hereinafter as the "Service")through PKFARE.com or our Affiliates’ site or other Mobile applications or software provided by PKFARE, it will forthwith be considered that you have given full approval to this Service Agreement. Before using the services of PKFARE.com, please be sure to read carefully, especially sections in bold font. If you do not agree with any of the following terms, please stop visiting this website or use this website’s service immediately.

1. General

This Agreement covers the terms of the Agreement, PKFARE's individual service agreements and other types of rules that have been published or are likely to be published on PKFARE website, including but not limited to disclaimers, privacy policy, bookings instruction, travel contracts, account agreement and other agreements ("Other Terms"). In the event of any inconsistency between this Agreement and the "Other Terms", the "Other Terms" shall prevail. Except as otherwise expressly stated, any PKFARE customer service is subject to this Agreement.

If you login as user of PKFARE affiliate or a partner company to access the PKFARE website or use the PKFARE service, you will be deemed to agree to all the terms of this Agreement and other rules, instructions and operating instructions published by PKFARE.

2. Service Description

PKFARE.com applies its own operating system to provide users with network membership services on the Internet. The users shall:

a) provide necessary devices, including a set of PC, a modem and network accessing devices.

b) access network and pay telephone bill associated with the services.

In view of the importance of PKFARE network membership services, the users agree:

a) to provide up to date, detailed and accurate personal information.

b) to constantly update registration information to ensure that such information is up to date, detailed and accurate. All originally typed information will be cited as registration information.

In addition, the user may authorize PKFARE to disclose the basic information to third parties, but PKAFRE can not disclose the user's supplementary information unless:

a) the user requests PKFARE or authorizes someone to disclose this information via e-mail service.

b) the corresponding legal requirements and procedures require PKFARE to provide user information.

PKFARE reserves the right to terminate the user’s membership to use PKFARE’s services if inaccurate personal information is provided.

Users agree to accept all kinds of information services provided by PKFARE, including but not limited to EDM, SMS, App information push, PC-side advertising and other services and marketing information.

3. Modification of Terms and Conditions

PKFARE may modify service terms and conditions when necessary, such as the development and modification of this agreement and / or rules with Internet-based and mobile-related services, should be noticed in this page and its corresponding pages in advance. The user should log in to this page and other related pages regularly to learn about the latest agreement. The changed agreements and rules will automatically take effect seven days after publication. If you do not agree to the relevant changes, you should immediately stop visiting PKFARE or use PKFARE services. If the user continues to use PKFARE services after seven days of the publication of changed agreement and rules, you have accepted the revised agreement and rules.

4. Service change, interruption, termination

You fully understand and agree that this service involves Internet and mobile communications and other services, which may be affected by various aspects of the impact of instability. the risk of discontinuance or termination of service due to unpredictability, computer viruses or hacker attacks, system instability, user location, user shutdown, GSM network, Internet, communication lines, and other reasons that PKFARE cannot predict or control, thus giving you the loss PKFARE does not bear the liability.

PKFARE requires regular or occasional maintenance or maintenance of the platform or related equipment that provides network services, and PKFARE does not have any responsibility for any interruption of network services (including fee-based network services) within a reasonable period of time, But PKFARE should be notified as early as possible.

You fully understand and agree that, except as otherwise provided in this Service Agreement, given the special nature of network services, PKFARE is subject to change, suspend or terminate some or all of the network services (including the charging network services) within reasonable period. PKFARE is not liable for above inevitable interruption of services but will make all the efforts to notify you in advance.

5. Usage Regulations

When using services provided by PKFARE.com, the user shall abide by the relevant laws and regulations of the People's Republic of China and other jurisdictions, if applicable. The user shall insure not to engage in any illegal or inappropriate activities while using the services, including but not limited to:

a) The uploading, displaying, disseminating or by any other means transmitting information containing any of the following:

ⅰ. Opposing the fundamental principles determined in the Constitution of the People's Republic of China;

ⅱ. compromising China's state security, divulging State secrets, subverting State power or damaging national unity;

ⅲ. harming the dignity or interests of China;

ⅳ. incitation of ethnic hatred or racial discrimination or damaging inter-ethnic unity;

ⅴ. sabotaging China's national religious policy or propagating heretical teachings or feudal superstitions;

ⅵ. disseminating rumors, disturbing social order or disrupting social stability;

ⅶ. propagating obscenity, pornography, gambling, violence, murder or fear or inciting the commission of crimes;

ⅷ. insulting or slandering others or infringing upon the lawful rights and interests of others;

ⅸ. including falsehoods, harming, threatening, or infringing upon the privacy of others, harassing, slandering, using vulgar language, profanity or other matters which are morally invidious; or

ⅹ. encompassing any other matters limited or prohibited by any laws, rules or administrative regulations of China or other jurisdictions, if applicable.

b) Using PKFARE's service system for any illegal purposes, including engaging in any of the following activities:

ⅰ. Enter into the computer information network or use the computer information network resources without authorization;

delete, edit or add functions to the computer information network without authorization;

delete, edit or add data or applications which are stored, dealt or transmitted in the computer information network without authorization;

intentionally create or disseminate computer viruses and other destructive programs; e) any other behavior which damages computer information network security.

ⅱ. Commercial use of any data display on PKFARE websites or belonging to PKFARE, including but not limited to copying, disseminating or by any means using such information without written consent in advance.

ⅲ. Using any device, software, procedure or other means to intervene or attempt to intervene in the normal operation, or any transaction or activity, of PKFARE, or committing any behavior leading to an unreasonable load of large data to PKFARE network devices.

ⅳ. Committing unfair competitive behavior which violates the Principles of honesty and credibility, or disrupting the transaction processes of PKFARE through actions such as malicious reservation or fraudulent transaction.

ⅴ. Other behavior not related to online transactions.

6. Copyright

Any user who accepts the terms of this Agreement shall indicate that the user's copyrights of information published in any form on this site includes, but is not limited to, reproduction, distribution, lease, exhibition, representation, broadcast , communication through information network, Filming, adaptation, translation, compilation and the other transferable rights that should be enjoyed by the copyright owner are exclusively transferred to the PKFARE operator, and the user permits that PKFARE has the right to sue for infringement of any subject and obtain full compensation.

This Agreement constitutes a written agreement under Article 25 of the “Copyright Law”, and its effect is applied to any content of protected by copyright law published by the user at PKFARE, whether the content is formed before or after the signing of this Agreement. The user agrees and has a clear understanding of above terms and will not publish or authorize any other websites and media to use the information published in PKFARE in any form (Except for PKFARE affiliated companies’ websites). At the same time, PKFARE retains the right to delete all types of information that do not meet the requirements without informing the user.

PKFARE Is operator of PKFARE.com, has the copyright of the contents and resources of this website and is protected by national intellectual property rights and enjoys the right of interpretation and modification of this website. without the express written permission of PKFARE. Any unit or individual may not copy, reproduce and quote in all or in part, in any form. Otherwise the Company will pursue its legal liability.

All information on PKFARE.com is governed by the Copyright Law of the People's Republic of China and relevant laws and regulations and all international intellectual property rights in China's accession. We have formulated the relevant measures and steps to protect the legitimate rights and interests of the intellectual property right holders. When the copyright owner and / or the right holder who can exercise the right of information network communication (hereinafter referred to as "the right holder") may find that there may be infringement of his right of communication through information network, the right holder shall issue a written notice to PKFARE in advance, providing valid ownership certificate and the site will remove the relevant content in accordance with the relevant provisions of the law. PKFARE has the right to use the information published by user on itself and affiliated company’s site (Including but not limited to pictures, travel, etc.). It is prohibited to reproduce, reprint or use the information in any form without the permission of PKFARE by third party. PKFARE.com is not responsible for any claims, damages, etc. caused by a user or other third party who violates this legal notice.

PKFARE does not guarantee the accuracy and completeness of the external links provided for the convenience of the user. Please call or email PKFARE to verify any copyright issue or other questions resulted by so. PKFARE will immediately delete or make corrections after verification.

7. User Privacy

Respecting user’s privacy is one of the principal policies of PKFARE. As supplement of the clause 2 – registration information, PKFARE will not publish, edit or disclose user’s supplementary information unless legal requirements or the following circumstances in good faith:

a) such information shall be disclosed by the company in accordance with laws, regulations or regulatory rules of China or other jurisdiction areas; and legal provisions or the company’s legal service procedures;

b) in order to safeguard the PKFARE’s ownership of trademark;

c) such information shall be disclosed under emergency circumstances in order to safeguard rights of members and the public;

other situations under which personal information shall be disclosed to a third party according to the law.

*Special Authorization

You fully understand and irrevocably, grant for free the following rights to PKFARE and its affiliates:

a) PKFAR's affiliates or partners may allow PKFARE users to login and use the services which they provide. The user's activities in such cases shall be subject to the terms and conditions published by the affiliate or partner. In order to implement the abovementioned functionality, you agree that PKFARE will synchronize your registration information and transaction data with the system of PKFARE's affiliates or partners, or allow their use of such information.

b) If you login to PKFARE using the account and password of PKFARE's affiliates or partners, in order to provide similar services and functionality, you agree that PKFARE will synchronize your registration information and transaction data from the account of PKFARE's affiliate or partner with PKFARE's own system, and allow their use of such information, and you agree that PKFARE and its affiliates or partners will bear no liability or consequences to you, if any.

c) To ensure transaction security, you agree that PKFARE and its affiliates may carry out data analysis using your information, and you agree to allow PKFARE and its affiliates to use result of such analysis for commercial purposes.

d) You agree to authorize and accept business information from PKFARE through your email, mobile phone and delivery address when you make use of various services provided by PKFARE. Such business information includes but is not limited to the latest products and promotions from PKFARE. If you prefer not to receive such information, you may unsubscribe by adjusting the relevant settings in PKFARE.

8. Security of User Account and Password

Once you register as a member of PKFARE, you will be assigned with an account and a password. You must well protect your account and password, Otherwise, all associated liabilities shall be borne by you. You will be responsible for the safety of your own account and password, and will assume full responsibility for any activity or events which occur from within the account. You may change your password at any time, or close your account and register a new one. If there is any illegal use of a member account or a loophole in security, the user shall inform PKFARE immediately. Please keep your password safe, never share your password with others. You shall bear any losses and liabilities due to improper password keeping. You have the right and responsibility for the activities, actions and events made through your account and are not allowed to transfer the account, authorize others to use your account and trade account with others in any form. Given the special nature of network services, PKFARE is not obligated to review whether you are using the username and password,but verify whether the user name and password are consistent with those stored in the database. Anyone who has entered the username and password which are the same as those stored in the database can log in and use the services of this account provided by PKFARE, PKFARE is not obliged to assume any responsibility.

9. Refuse to Provide Guarantee

The users clearly agree that they shall personally assume risks associated with the use of e-mail services. PKFARE clearly refuses to provide any type of guarantee, no matter explicit or implied. However, commercial implied guarantee, guarantee with specific purpose not against rules are not restricted. PKFARE does not guarantee that the services will certainly meet users’ requirements, that the services will not be suspended, and that the services will certainly be prompt, safe and free from mistake. PKFARE refuses to provide guarantee in any form, including information accuracy, promptness and smooth transmission. The users understand and accept that all information (downloaded or acquired through network membership services of the hotel) shall depend on the users and they shall assume all risks and liabilities on system damage or information loss. The users will not receive verbal or written opinions or information from PKFARE and will not make explicit guarantee hereby.

10. Limited Liability

PKFARE is not responsible for any direct, indirect, accidental, particular and ensuing damage arising from: inappropriate use of network membership services, illegal use of services or changes in information where information is provided by a user. Such damage may lead to damage to PKFRE image so that PKFARE has put forward the possibility of such damage in advance.

11. Storage and Limitation of PKFARE User Service Information

PKFARE is not responsible for the failure to delete or failure to store information provided by the user. PKFARE has not set an upper limit to the volume of data transferred but it reserves the right to terminate the user account if PKFARE deems in its own discretion that the user's behavior does not comply with the Terms of Use of PKFARE service or the user violates the regulations of the service clause. The copyright of all contents referred under this Terms of Use shall be jointly owned by the author and PKFARE. Anyone wishing to reproduce this article must seek authorization from the author or PKFARE.

12. User Content Management

The user is solely responsible for content which he / she publishes. When using this type of service, all local laws, national laws and international legal standards in areas where PKFARE provides service will apply. Users must comply with the following rules:

a) all published content must conform to relevant laws and regulations of China;

b) PKFARE's services must not be used for any illegal purposes;

c) interference or disturbance to the network service is prohibited;

d) user must comply with all the network agreements, regulations and procedures regarding the PKFARE’s services.

Membership services make use of the Internet to deliver and receive information. Hence, the behavioral guidelines of the user are subject to relevant laws and regulations, policies and procedures regarding the Internet. Users shall not disseminate any illegal, harassing, slanderous, abusive, threatening, harmful, vulgar or obscene information. Users shall not transmit any information that abets criminal behavior; encourages domestic disadvantage and national security, or violates local laws, national laws and international legal standards. Illegal or non-authorized access to other computer systems is prohibited. If the user's behavior is inconsistent with the aforementioned service clause, PKFARE may terminate the service account immediately in its sole discretion. Users shall assume the legal responsibility for their own behavior when using membership services. If the user spreads and propagates reactionary, pornographic or other information that violates national laws, the information received by membership service system may be disclosed and used as the evidence of the user's violations.

13. Guarantee

The users agree to safeguard and maintain the interests of all members of PKFARE and to pay attorney fee caused by the use of services beyond the service scope by the user, damage compensation for the violation of service terms and conditions and the recourse fee for other person to use the user’s computer, account and other intellectual property rights.

14. Termination of Service

The user or PKFARE may at any time terminate online service. PKFARE shall not be held responsible for any individual or third party due to terminating service at any time. If the user objects to any service clause, objects to any modified terms, or is dissatisfied with the PKFARE membership service, he/she shall take the following procedures:

a) cease to use PKFARE's services;

b) terminate PKFARE membership; and

c) inform PKFARE to cease providing services to such member. At the time of termination of membership services, the user's rights of using PKFARE membership will also be terminated, after which, PKFARE will discharged of any and all obligations and liabilities, if any, to the user.

15. Notification

All notices sent to the user may be transmitted by e-mail or conventional mail. PKFARE will send messages to users through e-mail and make announcements on the website, telling them about the modification of service terms and conditions, change of services or other important issues.

16. Participating in Advertisement Planning

If the users include publicity materials in information released by them, participate in ads planning, or display their products through the PKFARE’s network membership services, any of such promotion activities, including description on goods transportation, payment, services, commercial conditions, guarantee, ads and others shall occur only between the users and the ads vendors. PKFARE will not assume any responsibility. PKFARE is not obliged to assume any responsibility for such ads selling through its network membership services.

17. Ownership of E-mail Contents

Contents to be defined by the user include text, software, sound, photos, video and graphics; all contents in the ads; all contents of the e-mail; commercial information provided by the PKFARE network membership services for the users. All these contents are protected by laws on copyrights, the ownership of the trademark, labels and other properties. Therefore, the users can only use such contents upon the authorization of PKFARE and the ads vendors and shall not privately copy and reproduce such contents or create derivative products related to these contents.

18. Legal

E-mail service terms and conditions shall be consistent with the national laws, including disputable and contradictory contents in legal provisions. The users and PKFARE agree to be subject to the jurisdiction of the High Court. If any provision of any of PKFARE's Terms of Use is in conflict with the law, the provision shall be interpreted as closely as possible to its original meaning as far as allowed by law, and other provisions shall fully retain their legal force and effect. Any dispute which arises from the interpretation of this Terms of Use and any service through PKFARE shall be subject to the judgment of Shenzhen Nanshan District People's Court.

Terms & Conditions for Air Ticket Content

1. Flight and Price Searching

1.1. The fare displays on PKFARE is the lowest fare negotiated among the Global Ticketing Partners. In no circumstances shall PKFARE reveal any information including but not limited to Commission, Rate of Exchange, Original Currency, and Ticketing GDS related to the Global Ticketing Partners.

PKFARE does not honor any dispute on the fare rule and other conditions which had already been listed on the order. PKFARE reserves all the right for the explanation of the fare rule in case 1.2. PKFARE fails to display it correctly. In the meantime, PKFARE reserves all the right to charge the service fee on behalf of Global Ticketing Partners. Related scheme of service fee would be provided to buyer users.

2. Booking

2.1. Once buyer users accept the price and flight options, buyer users will be required to input the correct passenger information, the information including but not limited to Surname, Given Name, Date of Birth and Passport ID. PKFARE shall not take responsibilities of any loss including but not limited to be denied boarding or name correction by the Airlines caused by providing the inaccurate passenger information.

2.2. Buyer users are fully responsible for the validity and legality of the transactions. PKFARE reserves the right to refuse ticketing in case of the abusive of carriers’ fares and GDS. If such performance results in direct or indirect loss for PKFARE or its Global Ticketing Partners, PKFARE reserves all the right to recourse from buyer users. Meanwhile, buyer users should be responsible to manage all the accounts properly. PKFARE is not liable for or any direct or indirect lost due to the lose or stolen of the accounts.

2.3. Orders will be kept for 30 minutes when created by buyer users. And the booking associated with the order would be automatically cancelled if the payment has not been made by users within 30 minutes. In rare cases there may be fluctuation of price due to the availability or fare change, the final price is only confirmed while doing the payment. Buyer users may contact PKFARE customer service center to hold the orders for longer time within 30 minutes of order generation, but PKFARE is not able to commit the order validity after holding.

2.4. Duplicate bookings created beyond PKFARE should be cancelled in time in case the Airline cancels the ticketed bookings in PKFARE. PKFARE will not be liable for any direct or indirect loss caused by airline cancelling the ticketed booking due to duplicate bookings beyond PKFARE.

3. Settlement

3.1. Buyer users will have a 30-minutes window to accomplish the payment for each of the order from its generation. Payment methods are subject to the payment gateways supported by PKFARE. PKFARE shall not be liable for the validity of the orders which have not been paid within 30 minutes from its generation.

3.2. Once the payment has been made by buyer users, PKFARE gives tacit consent to that buyer users have come to the agreement on settlement with passengers. PKFARE shall not be liable for any loss for buyer users fail to collect payment from its passengers or take part in any communication directly with the passenger. Buyer users shall not request PKFARE to suspend the coupon status in any circumstances.

3.3. If pre-payment is selected as the settlement method, PKFARE shall not be paying any interest for the Pre-Payment. Buyer users shall be responsible for all bank fees and surcharges when pre-pay a certain amount to PKFARE’s bank account and PKFARE shall credit the funds as actual received from buyer users less bank fees and surcharges into buyer users’ pre-pay account and each of the transactions shall be deducted until not sufficient for one transaction.

3.4. If online instant payment is selected as the settlement method, photocopy of card holder’s official ID shall be provided according to this agreement. Buyer users shall be responsible for cases including but not limited to fraud and chargeback of the credit cards. The direct loss of PKFARE caused by the above cases shall be directly paid by buyer users with immediate effect, or PKFARE has the right to invalid such buyer user account until PKFARE receives the fund of the direct loss and indirect loss caused by above cases.

3.5. Buyer users shall contact PKFARE if system error occurs while processing the payment on PKFARE. PKFARE’s finance department shall investigate into the cases and refund the discrepancies back to the related accounts. If credit cards are declined or if there’s any dispute due to the above error, PKFARE would be able to assist. Investigations shall be made and solutions shall be provided by PKFARE within 3 business days, and refund of the discrepancies (if any) shall be returned within 5 business days.

3.6. All the refund shall be returned through its original channel. PKFARE shall negotiate with buyer users in case of the disputes on settlement and payment problems. PKFARE reserves the right to refuse on involving the third party like passengers/ the Airlines into the disputes.

3.7. PKFARE shall not provide the Itinerary issued by Accounting Center of China Aviation unless specified.

4. Ticket Issuance

4.1. Once payment is received and acknowledged by PKFARE, the ticket issuance will be processed immediately. Most of the tickets will be issued within 120 minutes since payment received. On rare cases when PKFARE fails to issue the tickets within 120 minutes, notifications along with related reason and alternative solutions shall be raised within 60 minutes. If buyer users fail to accept the alternative solutions, unconditional refund will be proceeded by PKFARE.

4.2. All the ticket issue requests shall be raised in PKFARE’s portal instead of oral notifications under any circumstances. No paper tickets will be provided. Itineraries will be provided by PKFARE in a specified format.

4.3. PKFARE reserves the right to refuse issuing the tickets while the flight departure time is less than 240 minutes.

4.4. In rare cases that buyer users or passengers receive related email/messages directly from the Airline which will not be considered as the notification and commitment from PKFARE.

4.5. Waitlisted or partial waitlisted bookings may be cancelled by the Airline at any time and PKFARE will not be liable to inform buyer users in case of cancellation. PKFARE would only inform buyer users in case of bookings waitlisted successfully.

5. Ticket Refund, Ticket Change and Ticket Void

5.1. Ticket Refund: For Voluntary Refund and refund without dispute, refund payment shall be accomplished within 20 business days of request received; For Involuntary Refund and the refund with dispute, related documents and certifications are required upon request. PKFARE shall apply Involuntary Refund to the corresponding Airlines and refund payments shall be accomplished within 20 business days upon written approval of the Airlines. On rare occasions that Involuntary Refund rejected by the Airlines, PKFARE customer service center shall contact buyer users for further action. (Related disputes shall be confirmed by Airlines arbitration)

5.2. Ticket Change: For the Reissue/Revalidation that can be executed by PKFARE, change shall be proceeded and accomplished within 240 minutes once the payment is confirmed*; For the Reissue/Revalidation that can not be executed by PKFARE, change shall be proceeded and accomplished by the next business day once the payment is confirmed.

5.2.1.1. *Exceptions: PKFARE will fully assist on but can not guarantee the ticket Reissue/Revalidation when the departure time of the requested flight is less than 24 hours. On special occasions including but not limited to booking class/price change, booking cancelled by the Airline after the payment is collected, PKFARE shall notify on buyer users within 60 minutes along with the alternative solutions. If buyer users fail to accept the alternative solutions, unconditional refund will be proceeded by PKFARE.

5.3. Ticket Void: Unless specified, PKFARE does not honor any Void request on issued tickets. *

5.3.1.1. *Exceptions: PKFARE shall provide buyer users with related time limits and regulations for ticket void services.

6. Flight Cancellation, Schedule Change Notification

6.1. Passenger Contact Information shall be provided by buyer users in case of Flight Cancellation and Schedule Change notification from airlines, or PKFARE shall notify buyer users with Flight Cancellation and Schedule Change and buyer users will be responsible to notify the passengers. *

6.1.1. *Exceptions: Notifications on Flight Cancellation and Schedule Change occurred within 6 hours of flight departure shall not be guaranteed.

6.2. PKFARE and its Global Ticketing Partners shall make all efforts to assist buyer users and their passenger(s) on the Change/Refund requests due to Flight Cancellation and Schedule Change. PKFARE and its Global Ticketing Partners shall not be liable for any loss due to the failure of such request.

7. Hours of Operation, Standardized Service and Emergency Service

7.1. PKFARE provides buyer users with 24/7 Standardized Customer Service, on which no addition charges shall apply. Manual Services like Re-pricing the existing orders or Ticket Change, Refund and Void supports shall be defined as Standardized Customer Service.

7.2. PKFARE provides buyer users with 24/7 Self and Emergency Service, on which no addition charges shall apply. Emergency Service shall be defined as situation like passengers are not able to Check-in the flights departure within 180 minutes by holding the successfully issued / changed tickets through PKFARE,

7.3. PKFARE shall collect additional charges on behalf of its Global Ticketing Partners in case of special requests like expediting the services to orders with flights which are not departing within 180 minutes. The additional charges shall diverse case by case and need to be confirmed by PKFARE Customer Service Center.

8. Abnormal Cases and Compensation Standard

8.1. PKFARE and its Global Ticketing Partners should ensure the accuracy and correction of tickets issued to buyer users. PKFARE takes limited liabilities due to PKFARE’s and its global ticketing partner’s mistake which caused passenger’s failure to travel as the ticketing itinerary:

8.1.1. PKFARE should arrange alternative flight(s) with same cabin class departs within 24 hours as the original itinerary passenger booked;

8.1.2. PKFARE should arrange passenger’s accommodations at the place of origin or transfer if it’s reasonable and necessary. The Standards are as below:

8.1.2.1. First Class: 5 Stars Hotel

8.1.2.3. Premium Economy and Economy Class: 3 Stars Hotel

If local hotels do not have any rank, PKFARE will arrange accordingly. PKFARE would not be liable for any compensation for hotels booked by passenger or buyer users without pre-authorization.

8.1.3. The compensation amount will be up to CNY (Chinese Yen) 1000/passenger or the equivalent of foreign currency additional to above arrangement.

8.2. Buyer users are responsible to check the validity and information correctness of the tickets. PKFARE is not liable for any mistake or error caused by the Airline or GDS. But PKFARE would assist buyer users on the communication and the claim for compensation with the Airline and GDS.

8.3. PKFARE shall take no responsibility to execute any related after-sale services for tickets which have been changed / refunded through channels / parties other than PKFARE.

8.4. In the situation of passengers fail to travel as the ticketing itinerary due to non PKFARE reasons, if buyer users want to ensure the passengers travel as the ticketing itinerary, buyer users have to book and pay the corresponding orders in PKFARE system again in order to get the new ticket issued. PKFARE will assist with claiming for compensation from related parties if it’s not the buyer users’ or passengers’ liability for such cases after verification.

Terms & Conditions for Hotel Content

1. Hotel and Price Search

1.1. The fare displays on PKFARE is the lowest fare negotiated among the global partners. PKFARE shall not provide users and their partners/check-in guests with the relevant information about the partners that have offered the reservation in reality in any case, including but not limited to the company name, discount rate, exchange rate and original currency, etc.

1.2. Tax authorities in some countries /regions may levy specific additional tax (i.e. tourist tax), which shall be paid locally. Users or/and check-in guests shall undertake the obligation to pay these taxes unilaterally. Except for the tax payment related to the service payment as mentioned in the article, PKFARE shall not collect the tax payment on behalf of relevant tax authorities. If appropriate, the global partners of PKFARE shall offer the invoice to PKFARE in regard to particular charge and tax payment (if applicable). The global partners of PKFARE shall submit the relevant tax payment to corresponding tax authorities. The prepaid tax collection in hotel transactions collected by PKFARE from the users refers to the estimated tax paid by PKFARE to its global partners as for the taxes in hotel occupancy (i.e. sales tax and use tax, occupancy tax, house tax, consumption tax and added-value tax, etc.), rather than the tax payment collected by PKFARE from users and submitted to relevant tax authorities. The actual tax paid by PKFARE to its global partners may change with the difference of tax amount, specifically depending on the valid tax rate and taxability, etc. when the users of PKFARE check into the hotel actually. PKFARE shall reserve the service charge, which will be regarded as the remuneration of offering the traveling reservation service to users. The service charge of PKFARE will change with the difference of reservation amount and type.

1.3. Unless specified, all terms of reservation are subject to the terms of the PKFARE website. In case the system does not display the reservation terms normally, PKFARE has the right to interpret the terms of the reservation. PKFARE retains the right to charge a service fee on a price basis on behalf of its global partners, but PKFARE should provide a price list of related services to customers. PKFARE will access third-party comments data for users’ reference only, but PKFARE is not responsible for the third-party review data. PKFARE will add hotel additional charges on the website for users’ reference only, which will actually be subject to hotel charges on site.

2. Reservation

2.1. Reservation information from users must be clear and accurate. Users should provide information required by PKFARE, including but not limited to the guest's name, child’s age information, mobile phone, etc. Once the reservation is successful, PKFARE does not bear the loss due to wrong guest information provided by users, including but not limited to being refused to check in by hotel or modification of the guest name.

2.2. The user is fully responsible for the authenticity and legality of the transaction. Any abuse of the hotel reservation operation, hotel prices, reservation system, etc., PKFARE has absolute right to refuse (including but not limited to disable the user account). If the abuse causes a direct or indirect loss to PKFARE and its global partners, PKFARE has a full recourse against the user. The user has the responsibility for the full management of his/her account, and PKFARE does not assume any direct or indirect loss to the user due to loss or theft of the account.

2.3. Unless specified, the order for the user's successful reservation will be retained for 30 minutes since created at PKFARE, and the user should complete the payment within 30 minutes. The price may change due to changes in hotel room prices and other reasons after the reservation, and it is specifically subject to the price when paying. If the user fails to complete the payment within 30 minutes, PKFARE has the right to cancel the order and reservation. Cancelled reservation can not be reversed, the user has to make new reservation if hotel reservation is still needed.

2.4. Users should promptly cancel the reservation of the same guests and same hotel through all channels in addition to PKFARE, because hotels or hotel suppliers will cancel all reservations based on repeated reservations, PKFARE does not incur any direct or indirect damages resulting from the cancellation of the repeated reservation by the hotel or hotel supplier.

3. Payment and Settlement

3.1. Unless specified, the user shall complete the payment within 30 minutes from the time the order was created, and the payment methods are subject to the payment gateways supported by PKFARE. PKFARE shall not be liable for the validity of the orders which have not been paid within 30 minutes from its generation.

3.2. Once the payment has been made by buyer users, PKFARE gives tacit consent to that buyer users have come to the agreement on settlement with guests. PKFARE shall not be liable for any loss for buyer users fail to collect payment from its guests or take part in any communication directly with the guests.

3.3. If pre-payment is selected as the settlement method, PKFARE shall not be paying any interest for the Pre-Payment. Buyer users shall be responsible for all bank fees and surcharges when pre-pay a certain amount to PKFARE’s bank account and PKFARE shall credit the funds as actual received from buyer users less bank fees and surcharges into buyer users’ pre-pay account and each of the transactions shall be deducted until not sufficient for one transaction. Transactions made through prepayment are exempt from merchant surcharges.

3.4. If online instant payment is selected as the settlement method, photocopy of card holder’s official ID shall be provided according to this agreement. Buyer users shall be responsible for cases including but not limited to fraud and chargeback of the credit cards. The direct loss of PKFARE caused by the above cases shall be directly paid by buyer users with immediate effect, or PKFARE has the right to invalid such buyer user account until PKFARE receives the fund of the direct loss and indirect loss caused by above cases.

3.5. Buyer users shall contact PKFARE if system error occurs while processing the payment on PKFARE. PKFARE’s finance department shall investigate into the cases and refund the discrepancies back to the related accounts. If credit cards are declined or if there’s any dispute due to the above error, PKFARE would be able to assist. Investigations shall be made and solutions shall be provided by PKFARE within 3 business days, and refund of the discrepancies (if any) shall be returned within 5 business days.

3.6. Unless specified, all the refund shall be returned through its original channel. PKFARE shall negotiate with buyer users in case of the disputes on settlement and payment problems. PKFARE reserves the right to refuse on involving the third party like guests/the hotels into the disputes.

4. Order Confirmation

4.1. After the user completes the payment successfully, PKFARE defaults that the order is entering the order-placing process. In most cases, PKFARE can confirm the order within 30 minutes from the successful payment of the order. If the order is not confirmed within 30 minutes due to special reasons, PKFARE should notify the user within 60 minutes, and inform the cause and solutions or alternatives, if the solution or alternative can’t be accepted by the user, PKFARE will refund to the user unconditionally.

4.2. All reservation requests must be submitted via PKFARE.com. PKFARE does not accept user's oral reservation request in any case. PKFARE only provides the user with the reservation voucher for the PKFARE specified format.

4.3. In very rare cases, the user will directly receive the relevant reservation e-mail / SMS and other notifications sent by the hotel. The notification can’t be considered as a notification and commitment of PKFARE to the user.

5. Cancel order / Modify order / No check-in / Checkout in advance/ Late checkout / Special request

5.1. The reservation is made via the PKFAR.com, indicating that the user agrees and accepts the relevant reservation conditions for the hotel (including the cancellation and non-check-in policy applicable to the reservation), and additional conditions of the hotel during the reservation or check-in, including the services or products offered by the hotel. You can view cancellation and non-check-in policies for each hotel on the hotel information page of PKFARE.com or "Reservation Conditions", "Cancellation Policy" or similar requirements. Please note that according to the hotel cancellation and non-check-in policy, you may need to pay the corresponding fee for cancellation of the reservation, in some cases, the cost is entire fee for the full accommodation period or the cost of the first night. We recommend that you read the hotel's cancellation and non-check-in policy before booking. Please take a closer look at the hotel's details on these conditions before booking. Some hotels may incur additional charges due to advance or late check-out. It is important to note that some hotels do not give specific policies and need to communicate with global partners alone through PKFARE.

5.2. Orders with cancellation policy of non-cancellation or non-modification, shall be implemented in accordance with the policy. Exception: for cancellation request, when the cancellation policy is non-refundable, PKFARE can assist in applying for the cancelation, but does not make any commitment to the results. Once the cancellation request is made, the original order is no longer retained. Any cancellation request for a reservation made later than the latest cancellation date (including the latest cancellation date) specified in the reservation, PKFARE will charge / deduct the corresponding cancellation fee in accordance with the order cancellation policy. If your guests are unable to check in on the basis of force majeure (such as natural disasters, emergencies, government expropriation, etc.), you need to contact PKFARE before the date of check-in and provide proof, PKFARE will assist in submitting the application to the hotel but not guarantee the result. If users want to modify the orders which are cancellable within the free cancellation period, users should cancel the original order and re-book if modification is needed.

5.3. Guests are required to arrive before the last retention time of the check-in date. Unless there is a special application, the hotel's latest reservation is the local time. Whether or not you have paid the room in advance, the guest who is unable to arrive before the last retention time of the check-in date or does not notice PKFARE in advance will be deemed to cancel the reservation, each room should must be paid for at least one night, or more room rate will be regarded as a cancellation fee, and the hotel may cancel all subsequent reservation rooms. If the guest requests a check-in or applies for a refund, PKFARE will communicate with the hotel but will not be responsible for the result.

5.4. If the user wants to make any changes to the order, you must directly contact PKFARE, rather than directly contact with the hotel. This stipulation applies to the check-in and check-out dates, extra beds, extended check-in, early check-out, late arrival and partially cancellation or full cancellation of all reservation. PKFARE will re-charge the customer for the fees due to the modification. Some hotels are unable to make any changes once the reservation is successful. Losses caused should be borne by the user. If you have any questions or concerns, please contact PKFARE customer service team before guests’ check-in or during the guests’ stay of the hotel.

5.5. For guests' special requests (non-smoking rooms, rooms with barrier-free access), users should contact PKFARE customer service team to ensure that the specific needs are met. Please note that all special requirements are subject to the actual situation, PKFARE can’t make any guarantee.

6. Protection Scheme

6.1. If confirmed orders are overthrown due to the original booked room are fully occupied or other reasons (guests haven’t checked in and the check in time is before 10:00am local time), PKFARE will coordinate to upgrade the original booked room to a higher category and befar the discrepancies for upgrading. If the booked hotel cannot accommodate the guests, PKFARE will place guests to same level hotels or hotels with higher levels within 5 kilometers from the original booked hotel. PKFARE will bear the discrepancies for such re-location arrangement. If PKFARE cannot place guests to a same level / upper level hotel due to regional restrictions, PKFARE will coordinate to accommodate guests to a lower category room type (lower category room type refers to the re-located room with rate lower than the original booked room). If guests accept the re-location solution, PKFARE will refund the discrepancy between the lower category room and the original booked room to users after guests check out. If guests don’t accept the re-location solution, PKFARE shall cancel the original order for free. Guests shall provide the proof of checking in the re-located hotel (invoice, payment slip etc.) to PKFARE. PKFARE will calculate the compensation based on the proof provided. The compensation amount for the discrepancy is up to 30% of the 1st night’s room rate of original order.

6.2. PKFARE will act immediately once acknowledges that the guests cannot check in upon arrival (check in time is after 10:00am local time). If the original booked room is not available, PKFARE will upgrade the room at same hotel for guests and bear the discrepancies for upgrading. If the original booked hotel cannot accommodate the guests, PKFARE will place guests to same level hotels or hotels with higher levels within 5 kilometers from the original booked hotel. PKFARE will bear the discrepancies for such re-location arrangement and the related ground transportation fees. If PKFARE cannot place guests to a same level / upper level hotel due to regional restrictions, PKFARE will coordinate to accommodate guests to a lower category room type (lower category room type refers to the re-located room with rate lower than the original booked room). If guests accept the re-location solution, PKFARE will refund the discrepancy between the lower category room and the original booked room to users after guests check out and reimburse the related ground transportation fees. If guests don’t accept the re-location solution, PKFARE shall cancel the original order for free. Guests shall provide the proof of checking in the re-located hotel (invoice, payment slip etc.) to PKFARE. PKFARE will calculate the compensation based on the proof provided. The compensation amount for the discrepancy is up to 100% of the 1st night’s room rate of original order.

6.3. Users should provide the check-in proof (invoice, payment slip etc.) of guests for applying the compensation. All the proofs shall be submitted to PKFARE within 14 days after guests check out. The submission date should be counted as the date PKFAFRE receives the proofs, failure to submit the proof before deadline is considered as giving up the protection scheme. Valid compensation proof includes guests’ payment slip or confirmation letter from the re-located hotel which should enclose the key information includes the guests’ name(s), hotel name, basic information (check-in and check-out date), payment amount etc.

6.4. “1st night’s room rate of original order”, “rate of original order” mentioned above is the settled rate between PKFARE and users. It’s not the sales rate from users to the guests.

6.5. Failure to contact PKFARE for coordinating on confirmed orders with which guests cannot check in successfully upon arrival will be considered as giving up the protection scheme rights voluntarily.

7. Ineligibilities for protection scheme

7.1. PKFARE has notified users the successful reservation is a duplicate reservation after verification, or the confirmed order has violated the distribution policy of hotels. (Hotel distribution policy refers to terms and conditions, notifications and other related published information on PKFARE.com).

7.2. Unforeseen circumstances or losses caused by users / guests modify the order directly through hotels rather than through PKFARE.

7.3. Unable to check in caused by force majeure (such as natural disasters, emergencies, government expropriation, etc.

7.4. Losses/Consequences caused by any conditions as guests haven’t checked in, guests haven’t provided true and valid check-in proof, the guests info in check in proof doesn’t match the guest info provided in original order including but not limited to the guest name, hotel city, check-in date, guest citizenship or other identification information.

7.5. Risks/Consequences caused by splitting Group Booking (same user account including sub user accounts book over 5 rooms in same hotel with same check in date online).

7.6. Guests request to change hotel due to dissatisfaction after check-in. Guests can contact PKFARE through users, PKFARE will recommend hotels nearby within its capabilities, but can not refund the fees for the original order nor compensating the discrepancies created by booking the recommended hotels. Guests is solely responsible for paying the fees for new bookings.

7.7. If hotels duly charge the items included in the original order, users can contact PKFARE directly and provide the payment proof (invoice or payment slip). PKFARE will act immediately and urge the hotel to refund directly. If hotel can not refund to the guests directly, PKFARE will request the hotel to refund to PKFARE and pass the refund to users. If guests want to add up services which are not included in the original order upon arrival such as adding breakfast, extra bed etc., users can request through PKFARE. PKFARE holds the right to offer such services or not, but the fees related to add up services which are not included in the original order should be paid by guests directly to the hotel.

8. Hours of Operation, Standardized Service and Emergency Service

8.1. PKFARE provides users with 24/7 Standardized Customer Service on which no addition charges shall apply. “Standardized Customer Service” defines as services related to existing orders on PKFARE.com including guest’s name changes, consultation about order details / check in related issues, notification of late check in, airport pick-up / send-off transportations etc. which request manual intervention.

8.2. PKFARE provides buyer users with 24/7 Self and Emergency Service, on which no addition charges shall apply. “Emergency Service” defines as services related to successfully confirmed reservations on PKFARE.com for special situations such as no reservation record can be tracked in hotel’s system upon arrival, un-able to check etc.
